Mr. Fagen was an Assistant Prosecutor with the Monmouth County Prosecutor’s Office. During his tenure in that office he rose to the level of Director of the Trial Division. While a member of the Prosecutor’s Office he tried numerous homicide cases, including several death penalty cases, sexual assaults, robberies, drug cases and virtually every type of criminal violation. Some of the trials included the prosecution of Richard Biegenwald, a serial murderer, and Pedro Radziwill. Mr. Fagen was one of the first attorneys to argue the constitutionality of the New Jersey death penalty before the Supreme Court of New Jersey.

DUI/DWI Defense

A DWI lawyer can help you if you have been arrested for a DUI. DUI in New Jersey is a serious charge. In New Jersey a blood alcohol content of greater than .08% or greater makes it illegal to operate a motor vehicle. For commercial drivers that limit is further reduced to 04%. Municipal Offenses

Cases heard in municipal court are divided into four general categories:

  • Violations of motor vehicle and traffic laws
  • Violations of disorderly and petty disorderly persons offenses (criminal matters which may result in fines or jail)
  • Violations of Fish and Game laws, Parks and Forests, Weights and Measures, SPCA, and Boating Regulations
  • Violations of municipal ordinances (local laws)

More serious offenses, known as indictable offenses, are sent to the County Prosecutor’s office. The County Prosecutor decides whether to present the case to a Grand Jury or to return the case to the municipal court as a less serious offense (a downgrade).
